FACT CHECK: Giannoulias Contradicts Previous Statements on Bank Loans to Mobsters

Background: This morning, during a radio appearance on WGN-AM, Alexi Giannoulias made several statements that contradict previous accounts by him and his brother with regard to loans made to convicted mobsters while Alexi Giannoulias was Senior Loan Officer at Broadway Bank.

New Misleading Giannoulias Said: “Now, you know, there are some people who in a perfect world we never would have done business with.”

  • FACT: Broadway Bank was aware of Michael “Jaws” Giorango’s mob record when they loaned him money. “Demetris Giannoulias said the bank learned of Giorango’s bookmaking and prostitution promotion convictions from a spring 2004 Tribune report detailing those cases… He said he asked Giorango about the convictions and Giorango said, ‘It’s in the past. I don’t do that anymore.’” (Chicago Tribune, 4/2/10)
  • FACT: Alexi said he knew Giorgano had “legal problems.” “Giannoulias insisted he only knew that Giorango had ‘some legal problems’ while he was servicing the loans, declining to say whether he knew they were criminal in nature.” (Chicago Sun-Times, “Giannoulias: I Take It Back,” 4/27/06)
  • FACT: Alexi knew about Giorango’s past and thought he was “a very nice person.” “He described Giorango as ‘a very nice person’ and questioned whether Giorango actually was a criminal. ‘Is he a crime figure?’ Giannoulias asked. ‘I don’t know what the charges are that makes him this huge crime figure.’”  (Chicago Tribune, 3/15/06)

Misleading Giannoulias Statement: “You look at the credit worthiness of the borrower, you look at the appraisal of the property…You don’t do criminal background checks on who they give loans to.”

  • FACT: Alexi made loans despite full knowledge of criminal backgrounds. “‘If every time someone got arrested the bank threw them out, I think it would be a problem,’ Alexi Giannoulias said. ‘We look at the commercial viability of loans, and that’s where we make our credit decisions.’”  (Associated Press, 4/8/06)
  • FACT: We are supposed to believe that a community bank helped mobsters finance a casino riverboat marina in South Carolina because it was a good investment. “‘From a commercial standpoint, it looked like a loan that should be made,’ Giannoulias said, adding he was unaware the marina was used to dock a SunCruz Casinos riverboat.” (Chicago Tribune, 4/9/06)

Misleading Giannoulias Statement: “I wouldn’t know what a mafia guy looked like if he walked down the street.”

  • FACT: Alexi Giannoulias visited mobster Michael “Jaws” Giorango in Miami. “Giannoulias said he traveled to Miami ‘about a year or two ago’ to inspect property the bank had financed for Giorango and met with him there. Giannoulias declined to provide details of that meeting.” (Chicago Tribune, 4/27/06)
  • FACT: Alexi admitted meeting Giorango at the bank “a few times.” “But Giannoulias said that since he became a full-time senior loan officer, he has met Giorango at the bank ‘a few’ times.” (Chicago Tribune, 3/15/06)

Giannoulias Tries to Shift Blame for Springfield’s Debt Problems, Continues to Mislead Voters

Background: During an appearance last night on Fox Chicago, Alexi Giannoulias continued to mislead voters about Congressman Kirk’s record while attempting to shift blame away from his failed leadership for the economic problems facing the State of Illinois.

Giannoulias Myth: “What happened in Greece, what happened in Springfield, what Mark Kirk and George Bush have been a part of and Congress has been a part of, and that’s really saddling the next generation with disgusting levels of debt.”

Get the Facts: Alexi Giannoulias cannot blame Mark Kirk for his failed leadership in Springfield.  While the national unemployment average stands at 9.5%, Illinois’ unemployment rate stands at 10.4%.  The New York Times recently dubbed Illinois “Greece by Lake Michigan” noting the skyrocketing debt and unfunded liabilities in Springfield.  In June, Fitch downgraded Illinois’ generation obligation bond rating to ‘A’ with a negative outlook and downgraded its appropriations rating to ‘A-.’

Giannoulias Myth: “He voted against extending unemployment benefits.”

Get the Facts: Kirk voted to extend unemployment benefits five times in the last two years: On October 2, 2008, Kirk voted in favor of extending benefits.  Kirk repeated his votes in favor of extending unemployment benefits on November 5, 2009February 25, 2010March 17, 2010 and on April 15, 2010.  Congressman Kirk has said he would vote to continue unemployment insurance benefits again if Congress pays for it by cutting other spending.

Giannoulias Myth: “He voted against time after time increasing the minimum wage.”

Giannoulias Myth: “Yet has no problem increasing his own salary.”

Get the Facts: On April 27, 2010, Congressman Kirk voted to forego a pay raise for Fiscal Year 2011.

Giannoulias Myth: “I am the only candidate who is out there proposing a plan to create jobs.”

Get the Facts: Mark Kirk has outlined his plan to help small business employers grow their businesses and create jobs.  His Small Business Bill of Rights is endorsed by the National Federation of Independent Business.

FACT CHECK: “Mob Banker” Who Never Served Attacks Decorated Naval Officer’s Distinguished Service Record

On Saturday, a Washington Post reporter noted that the Alexi Giannoulias campaign was involved in a story entitled “Illinois Senate candidate admits claim about military award was inaccurate.”  The Giannoulias-provided story and some follow-up stories were inaccurate and merit correction.

Fact Checks on the Giannoulias-Provided Story:

#1: Giannoulias Provided Story Diminishes Kirk’s Outstanding Service

First, the Giannoulias-provided story diminishes Kirk’s Kosovo service by describing him only as “the intelligence officer for a single squadron at Aviano.”  In fact, Kirk took charge of four squadrons and served as the lead officer for a combined intelligence team – the largest EA-6B intelligence shop in the history of naval aviation. #2: Giannoulias Provided Story Diminishes Kirk’s Distinguished Award

Second, the Giannoulias-provided story incorrectly suggests that the Rufus Taylor Intelligence Award is a non-Navy award.  In fact, the “United States Navy Vice Admiral Rufus L. Taylor Intelligence Award” is nominated and selected by the Navy, and then presented by the National Military Intelligence Association. (Source: Navy Reserve Intelligence Command Award Manual)

#3: Giannoulias Provided Story Presents False Award Comparison

Third, the Giannoulias-provided story and other news outlets have incorrectly suggested that the Rufus Taylor Intelligence Award is less distinguished than a different award called the “Junior Officer of the Year Award.”  In fact, both awards are nominated and selected by top Navy Reserve Intelligence Command officials. You cannot be accused of exaggerating something when there’s nothing to exaggerate.  The two awards in question are equal in stature. #4:  Giannoulias Provided Story Suggests Kirk Did Not Earn Award

Fourth, the Giannoulias-provided story inaccurately suggests that Kirk did not personally earn the Rufus Taylor award since it was presented to a unit.  In fact, the “unit” that received the award was an ad-hoc intelligence team that Mark Kirk established and ran to support Electronic Attack air combat operations during Kosovo.  Kirk was presented with the award at the National Military Intelligence Association’s annual awards banquet. The Real Facts Are Clear

In 1999, Mark Kirk was the Intelligence Team Leader for Electronic Attack Wing Aviano during Operation Allied Force.  In December of that year, he was awarded the Navy and Marine Corps Commendation Medal for his service.

In 2000, Kirk and his team were recipients of the Rufus Taylor Intelligence Award – a distinguished national award for which the Navy selects one winner every year – which “commemorates the exceptional achievements of an outstanding Naval Intelligence career professional.”

As leader of the team that received an annual Navy intelligence professional award, Kirk incorrectly referred to himself as the “Intelligence Officer of the Year,” a term which can be associated with the Navy Reserve Intelligence “Junior Officer of the Year Award.”  Since both awards carry equal distinction, this is a case of misidentification and not exaggeration.  You can learn more about the awards here.

Mark Kirk and his team rightly earned the Rufus Taylor Award and their service should not be diminished.  Kirk’s former Commanding Officer says he was “proud to nominate Mark Kirk” for the award – and called Kirk “the best intelligence officer” he ever served with.  See statement.

How Does Alexi Giannoulias Compare to Mark Kirk?

While Mark Kirk has served in the Navy Reserve for 20 years, Alexi Giannoulias never served in the military.

While Mark Kirk was running intelligence support for electronic attack combat missions in Operation Allied Force (Kosovo), Alexi Giannoulias was playing basketball in Greece. (Washington Post WhoRunsGov.com).  In brief, while Mark Kirk wore a U.S. Navy uniform, Alexi Giannoulias wore a basketball uniform in Greece.

While Mark Kirk was supporting electronic attack missions over Iraq, Alexi Giannoulias was partying in New Orleans at Tulane Law School. (Washington Post WhoRunsGov.com)

While Mark Kirk was serving in the National Military Command Center without any pay, Alexi Giannoulias was making loans to organized crime leaders (Chicago Tribune, 4/1/2010) and pushing risky banking schemes that brought down his family bank. (New York Times, 1/30/2010)

While Mark Kirk was serving in Afghanistan, Alexi Giannoulias was covering up the millions of dollars he wiped out in the Bright Start college savings program. (Chicago Tribune, 12/23/2009)

Mark Kirk’s military service should not be denigrated by a 34-year-old media-dubbed “mob banker” who has never served our country in uniform, whose reckless lending practices cost the FDIC $394 million when they closed his family bank (FDIC, 4/23/2010), and whose risky investments cost Illinois families tens of millions in losses from the state’s college savings fund. Giannoulias Continues Misleading Attacks as Illinois Employers Endorse Mark Kirk for Senate

Giannoulias Myth: Mark Kirk repeatedly voted against extending unemployment benefits.

Get the Facts: Kirk voted to extend unemployment benefits five times in the last two years: On October 2, 2008, Kirk voted in favor of extending benefits.  Kirk repeated his votes in favor of extending unemployment benefits on November 5, 2009February 25, 2010March 17, 2010 and on April 15, 2010.   Congressman Kirk also publicly opposed Republican Senator Jim Bunning’s attempt to block extension of unemployment benefits earlier this year.

Giannoulias Myth: Mark Kirk supported continuing certain tax breaks for overseas investments by American firms.

Get the Facts: This is the same false claim Alexi Giannoulias made in his latest TV attack ad.  The truth is that Congressman Kirk joined 154 House Democrats and 23 Independent Republicans to oppose the American Jobs Creation Act (28 Democrats and 203 Republicans voted for its passage).  Congressman Kirk actually voted twice against this bill (Roll Call 259, June 17, 2004; Roll Call 509, October 7, 2004)

Failed Banker Alexi Giannoulias’s Attempt to Change the Subject

Ad Announcer: Republican Mark Kirk – here’s what he doesn’t want you to know – he voted for all the Bush policies that got us into this mess, like tax breaks to ship jobs to China.  [Ad Graphic:  “Voted to Ship Jobs Overseas – vote 258, 6.17.04”]

Fact: The vote referenced is a procedural motion relating to the American Jobs Creation Act.  What the Giannoulias campaign neglects to mention is that Congressman Kirk joined 154 House Democrats and 23 Independent Republicans to oppose this bill (28 Democrats and 203 Republicans voted for its passage).  Congressman Kirk actually voted twice against this bill.[1]

Financial Regulation: Mark Kirk supports financial regulation to protect consumers and our economy.  In 2002, he voted for the Sarbanes-Oxley Act, which instituted strict reporting requirements on corporations.[2]

In 2005, Kirk supported the Federal Housing Finance Reform Act, which would have created a stronger regulator of government-sponsored mortgage giants Fannie Mae and Freddie Mac.[3]  The new regulator would have had the power to require increased capital reserves at Fannie Mae and Freddie Mac and limit their loan portfolios.

Ad Announcer: “Then, after six straight months of job loss, Kirk voted against extending unemployment benefits saying unemployment isn’t a big issue.”

Fact: The vote the Giannoulias campaign references is from June of 2008.  Below is the national unemployment rate for the six months prior. [4]

June, 2008 – 5.5%

May, 2008 – 5.4%

April, 2008 – 5.0%

March, 2008 – 5.1%

February, 2008 – 4.8%

January, 2008 – 5.0%

The Giannoulias campaign is factually wrong.  Unemployment had increased for two months prior to the June unemployment vote, not six.  At the time of the vote, unemployment in Kirk’s congressional district stood at only 5.5%.  Additionally, Kirk voted against the legislation because it would have allowed people who had been employed for as little as two weeks to claim taxpayer-funded unemployment benefits.[5]

Kirk voted to extend unemployment benefits five times in the last two years: On October 2, 2008[6], Kirk voted in favor of extending benefits.  Kirk repeated his votes in favor of extending unemployment benefits on November 5, 2009[7], Feburary 25, 2010[8], March 17, 2010[9] and on April 15, 2010[10], little more than two weeks ago.

Kirk publically opposed Republican Senator Jim Bunning’s attempt in late February/early March to block extension of unemployment benefits.[11]

Ad Text: “Giannoulias saved 600 jobs at Hartmarx – Daily Herald – 6/30/09”

Fact: Nowhere in any Daily Herald article, or any newspaper article period, does the phrase “Giannoulias saved 600 jobs at Hartmarx” appear.

Furthermore, under the deal Giannoulias is claiming credit for, which kept Hartmarx open in Des Plaines, the company’s plant in Rock Island closed – 300 people lost their jobs.[12]

During the primary election, a Quad Cities reporter noted the Giannoulias campaign’s oversight:

In new television ads, U.S. Senate candidate and state Treasurer Alexi Giannoulias is touting his role in the sale of the Hartmarx clothing manufacturer, and by extension, Seaford Clothing Company in Rock Island.

“In tough economic times, it’s important that we send people to Washington that know what it takes to create and save American jobs,” his campaign released. “When the workers of Hartmarx needed someone, Alexi was there.”

Granted, 600 or so Illinois jobs were saved by the sale of Hartmarx. But perhaps no one mentioned to Mr. Giannoulias’ campaign that Seaford Clothing Company did indeed close, leaving more than 300 people out of work.[13]

Giannoulias in his own ad: “[People] want someone who is going to fight for them.  Someone who has been through tough times.”

Fact: Alexi Giannoulias is the son of a multi-millionaire and is a multi-millionaire himself.  His only job prior to becoming Illinois Treasurer was working at his family’s bank.  Giannoulias financed much of his first political campaign with $3 million from his family fortune – taken from profits out of the Broadway bank.[14]

Giannoulias described the $2.5 million he received in dividends from Broadway Bank in 2007 and 2008 as a “minimal” amount.[15]  From 2005 to 2007 Giannoulias reported at least $1.3 million in income every year.  In 2008 he took a pay cut to an annual salary, his lowest, of $361,000.[16]  Giannoulias’ family is slated to receive up to $15 million in federal tax refunds due to the collapse of Broadway Bank.[17]

Misleading Giannoulias Claim: “Because of the unprecedented real estate market collapse, the family business I left years ago, along with hundreds of other community banks, is now in peril.”

Get the Facts: Broadway Bank is nearing collapse because Alexi Giannoulias and his family pushed reckless lending schemes, “hot money” investments and loans to organized crime leaders – not exactly your typical community bank.

  • On January 26, 2010, the Illinois Department of Financial and Professional Regulation and the FDIC ordered Broadway Bank to “cease and desist from engaging in unsafe and unsound banking practices.” (www.idfpr.com)
  • From 2002 to 2006, Alexi Giannoulias increased Construction & Development loans from $80 million to $356 million – expanding such risky investments from 25 percent to 46 percent of the bank’s total loan portfolio. (Chicago Reader, Alexi’s Albatross, 12/3/09)
  • From 2002 to 2006, Alexi Giannoulias increased the bank’s brokered deposits (also known as “hot money”) fourfold to $640 million. The typical bank at this point was growing brokered deposits at about 9 percent a year. (“As Lender, Senate Candidate Impacted Bank Woes,” New York Times, 1/30/10)
  • When Alexi Giannoulias left the bank, the ratio of brokered deposits to total assets at Broadway was 68 percent, according to FDIC records.  The average for all federally insured banks nationwide was 4.5 percent. (Chicago Reader, Alexi’s Albatross, 12/3/09)

Misleading Giannoulias Claim: “We stood up to Oppenheimer when it mismanaged Bright Start.”

Get the Facts: Alexi Giannoulias’ decision to invest Bright Start funds in Oppenheimer’s high-risk fund wiped out $150 million in college savings for Illinois kids.  Giannoulias brokered a secret settlement agreement to recover only half those funds.  Now Alexi Giannoulias will only allow Illinois families to collect the settlement money if they promise not to sue him.  Meanwhile, Giannoulias still refuses to break the state’s contract with Oppenheimer.

“In recent months, Giannoulias has come under fire for his stewardship of the $2 billion Bright Start program, a college savings plan that is supposed to allow parents to put away money and earn interest on the cash for their children’s education. The fund lost more than $85 million last year in large part, Giannoulias has said, because of the management of OppenheimerFunds. (John Chase, “Bright Start Funds Used For New SUV,” Chicago Tribune, 5/4/09)

“The losses in a mutual fund that was part of the Illinois Bright Start college savings plan totaled about $150 million in 2008, more than double what the state had previously disclosed. As a result, families will recoup about half of what they lost, where six months ago some expected to recover a higher percentage of their losses.” (Chicago Tribune, “College Fund Settlement Less Than Expected,” December 23, 2009)

However, what parents may not be expecting is who else gets a legal waiver under the settlement letter: Illinois Treasurer Alexi Giannoulias.  That’s right. The settlement letter releases from all future claims not only Oppenheimer, which is paying that $77.25 million, but “the Office of the Illinois State Treasurer” and its sundry assistants and consultants, on whose watch the $150 million was lost. Now, it’s time for the State of Illinois to exact retribution by canceling its seven-year contract with OppenheimerFunds, a contract that runs until 2014. Surely, the estimated 4,400 students and families who lost nearly half their money in mismanaged Bright Start accounts should get the satisfaction of seeing that the fund management company is also paying a price. Misleading Giannoulias Claim: “I became the first senate candidate in Illinois history to refuse money from federal lobbyists and corporate PACs.”

Giannoulias said he didn’t negotiate the loans for Michael Giorango, a convicted bookmaker and prostitution promoter, but he is responsible for servicing nearly all of the loans at his family’s Broadway Bank. ‘So I am involved, and I do take responsibility for the loans that the bank makes,’ said Giannoulias…” (CBS 2 Chicago, 4/26/06)

2. Why did Broadway Bank continue to loan money to Michael “Jaws” Giorango and Demitri Stavropolous after the Chicago Tribune identified them as organized crime leaders in 2004?

Demetris Giannoulias said the bank learned of Giorango’s bookmaking and prostitution promotion convictions from a spring 2004 Tribune report detailing those cases… He said he asked Giorango about the convictions and Giorangosaid, ‘It’s in the past. 3. Why did Alexi Giannoulias meet with Michael “Jaws” Giorango in Miami after the Chicago Tribune identified him as an organized crime leader?

“When the family bank was flying high and Giannoulias had his eye on the treasurer’s office, he was the senior loan officer, but when the tough decisions were made or the questionable characters came to call, it was almost always Alexi’s day to empty the wastebaskets.”

On Tuesday night, after Congressman Mark Kirk presented a positive vision of reform and economic growth for the State of Illinois, Alexi Giannoulias immediately launched flailing negative attacks against Congressman Kirk to distract voters from serious questions surrounding his candidacy:

  • Alexi lost $150 million in Bright Start college savings for Illinois families and failing to recover nearly half the state’s losses (Chicago Tribune, 12/23/09);
  • Alexi and his family removed $70 million out of Broadway Bank in 2007 and 2008 – just before bad investments made on Giannoulias’ watch brought the family bank to near-collapse (Crain’s Chicago Business, 2/1/10);
  • Alexi approved loans for mobster Michael “Jaws” Giorango, who was convicted in 2004 for running prostitution rings and in 1988 on illegal gambling charges (Greg Hinz, “Alexi’s Business,” Crain’s Chicago Business, 3/13/06);
  • Alexi approved loans to Boris Stratievsky who was indicted on money laundering charges (David Jackson, “Giannoulias Speaks Up On Loans,” Chicago Tribune, 4/27/06);
  • Alexi approved loans for convicted felon and Blagojevich fundraiser Tony Rezko.  Tony Rezko secured a $1 million loan in September 2002 from Broadway Bank (Steve Patterson, “More Trouble For Rezko,” Chicago Sun Times, 10/13/06).  Tony Rezko also bounced nine checks from Broadway Bank in Las Vegas. FACT CHECK: Earmark Moratorium

Myth: Misleading reports claim Congressman Kirk rejected Washington’s system of wasteful, pork-barrel earmarking earlier this year.

Fact: After successfully defeating the infamous Alaskan “Bridge to Nowhere” in 2007, Congressman Kirk joined then-Senator Barack Obama and Senator John McCain in issuing a self-imposed earmark moratorium during the 110th Congress and led efforts to reform the corrupt and wasteful system – 18 months before his decision to run for U.S. Senate.  Congressman Kirk remains the only member of the House Appropriations Committee – Republican or Democrat – who does not request earmarks.  Earlier this year, Congressman Kirk cosponsored H.Res. 85 to prohibit members of Congress from requesting earmarks for organizations that contributed to their campaigns.

This week the House of Representatives passed an ethics bill that created an independent office to field complaints and investigate the conduct of members of Congress. I voted for these reforms, but they did not go far enough with regard to Congressional spending earmarks.

Since taking office in 2001, I requested grants to help many programs in my district. My job is to fight for my communities and I do. Last year, I secured:

  • A $846,000 grant for the Waukegan Police Department to fight the more than 3,000 gang members operating north of Lake-Cook Road,
  • $335,000 for developmentally-disabled employment in Northbrook, and
  • $245,000 for economic development in the second poorest town in Illinois, North Chicago.

I strongly supported each request. But my job also is to fight for our country. There are some in Congress who abuse the current system. Increasingly, Congress approves low- or no-quality projects throughout this nation. For every grant to fight gangs in Lake County, the Congress approves a new “Bridge-to-Nowhere” or “monument-to-me” with little public benefit.

Should the taxpayers build a $320 million bridge from a town of 8,000 to an island with a population 50? No. Should taxpayers foot a $243,000 bill so that school kids in Berkeley, Calif., can eat gourmet, organic school lunches featuring “Comté cheese soufflé with mâche salad” or “Meyer lemon éclairs with huckleberry coulis?” No.

It is because of these abuses that I became the first House appropriator to enact a moratorium on earmarks until reforms are established that boost transparency, accountability and quality of Congressional spending decisions. I joined 32 of my colleagues including Sens. McCain (R-AZ), Clinton (D-NY) and Obama (D-IL) to back a moratorium with reforms in how Congress spends taxpayer dollars. Chairman Waxman (D-CA) and Minority Leader Boehner (R-OH) are among major backers in the House.

Many congressional funding requests are worthwhile, but some do not pass the laugh test. We believe key reforms should be put in place before another series of spending bills are written.

I hope my colleagues join me in backing a moratorium on earmarks until we can enact these reforms to improve how taxpayer dollars are spent.

Congressman Kirk on Earmarks for Campaign Contributors

While some earmarks are secretly inserted into Congressional spending bills without transparency or regular committee consideration, every earmark Congressman Kirk ever requested was fully transparent, open to public inspection and voted upon by Congress.

Congressman Kirk’s earmark requests included $197,500 for a battered women’s shelter, $350,000 for a job training program for special needs adults, $350,000 to help Latina mothers learn English, $200,000 to train teachers of the deaf, $100,000 to establish the first-ever World War II Black Navy Veterans Memorial, $100,000 for anti-gang efforts, and $125,000 for a Latino leadership program.

Congressman Kirk is a cosponsor of H.Res. 85, a bill to prohibit members of Congress from proposing earmarks for any organization they had received contributions from, including lobbyists, employees or political action committees affiliated with that company, union or group.

“We can no longer accept a process that doles out earmarks based on a member of Congress’ seniority, rather than the merit of the project,” Obama’s statement said.  “The entire earmark process needs to be re-examined and reformed. President-elect Barack Obama vowed Tuesday to bar lawmakers’ pet projects from his massive economic stimulus plan and to bring unprecedented accountability to federal spending.  He told reporters at his transition office that his package will set a “new higher standard of accountability, transparency and oversight.
